TERMS OF PURCHASE

KATRINA COX NUTRITION LLC.

By clicking “Buy Now,” “Purchase,” or any other phrase on the purchase button, entering your credit card information, or otherwise enrolling, electronically, verbally, or otherwise, you (“Client”) agree to be provided with products, programs, or services by KATRINA COX (“Company”, “We” or “us”), acting on behalf of KATRINA COX NUTRTION, LLC. (“Company”), and you are entering into a legally binding agreement with the Company, subject to the following terms and conditions:

  1. TERMS.
    (a) Upon execution of this Agreement, electronically, verbally, or otherwise, the Company agrees to provide services in accordance with the products, programs, and/or services (collectively known as the “Services”) as outlined on www.katrinacoxrd.com, https://katrinacoxrd.myshopify.com/ and/or any associated domains (collectively known as the “website”).


(b) The scope of services rendered by the Company pursuant to this contract shall be solely limited to those contained therein and/or provided for on the Company website and/or the Sales page associated with the said Services.


(c) The Company reserves the right to substitute services equal to or comparable to the Program for Client if reasonably required by the prevailing circumstances.


(d) Client agrees to be open, present and prepared to complete the work. Client agrees that they are solely responsible for his/her own success and implementation of objectives met.


(e) The Company may recommend dietary and/or lifestyle suggestions, but these are wholly the Client’s responsibility and choice on whether to implement such changes.


(f) Company provides Client with a single-user license authorizing Client to use the materials for their individual purposes only. Client shall not share, copy, distribute, disseminate, or sell the materials and/or any login information either for commercial or non-commercial use.

  1. METHODOLOGY. Client agrees to be open minded to Company’s methods and partake in services as proposed. Client understands that the Company has made no guarantees as to the outcome of the programs and/or products.

We do not offer any representations, guarantees, or warranties, of any variety, regarding the services in any way. The service is offered “AS IS” and without representations, guarantees, or warranties of any kind, including but not limited to, implied warranties of merchantability and fitness for a particular purpose, neither express nor implied, to the extent permitted by law. We are not liable for damages of any kind related to your use of the Product.

  1. DISCLAIMERS. By participating in these services, Client acknowledges that Katrina Cox is a Registered Dietitian and Nutrition Coach. She is not a medical doctor, psychologist, therapist, or other licensed medical professional and her services do not replace the care of other professionals. You are expected to discuss any changes to your health, diet, or exercise regimen with your physician or another medical professional first before trying them. We are not responsible for any adverse effects or consequences that may result, either directly or indirectly, from any information or advice provided.

This service is for informational and educational purposes only. The information and education provided in this service is not intended or implied to supplement or replace professional medical treatment, medical nutrition therapy, advice, nutrition or dietetics advice, and/or diagnosis. This service does not provide medical nutrition therapy or individualized nutrition coaching and/or counseling services.

Although we do our best to make sure all of the service’s content is up to date and/or accurate, we do not make any representation that all the information is accurate or free of errors at all times. We do not assume any responsibility for accuracy of the service’s information, or its safety or efficacy as it applies to you. You should review any and all changes to your diet, lifestyle, exercise regimen, or supplement routine with your medical professional.

Any testimonials shown through Company’s website are only examples of what may be possible for Client. There can be no assurance as to any particular outcome based on the use of Company’s programs, and/or services. Client acknowledges that the Company has not and does not make any representations as to a future outcome of any kind that may be derived as a result of use of Company’s website, programs, products or services.

  1. ASSUMPTION OF THE RISK. YOU MUST ENSURE YOU ARE PHYSICALLY AND MEDICALLY CLEARED BY YOUR PHYSICIAN TO PARTICIPATE IN THE SERVICES RECOMMENDATIONS BEFORE PARTICIPATING. If you have any injuries or medical limitations, please have them cleared by your physician before attempting to participate in the Product.

By participating in the product, you are assuming the risk of participating in it and agree to only participate if medically cleared to do so. We are not responsible or liable for your participation in the services.

  1. INTELLECTUAL PROPERTY RIGHTS. The services and its content are intellectual property owned by Katrina Cox and Katrina Cox Nutrition LLC. Any violations of this term, and all terms contained herein, will be legally pursued to the fullest extent permitted by law.
  2. NO SHARING. You cannot distribute, copy, forward, and/or share the service or its content with anyone else. Any violations of these Terms of Use will be legally pursued to the fullest extent permitted by law.


You may not share your password or login information with anyone. If you share your password or login with anyone who did not purchase the Product, you will be removed from the Product immediately and no refund will be issued.


  1. YOUR RELEASE OF US, INDEMNIFICATION, HOLD HARMLESS. To the fullest extent permitted by law, Katrina Cox Nutrition LLC expressly disclaims liability for any direct, indirect, and/or consequential damages suffered by you related to your purchase or use of, or participation in, the services, its materials, our website, or any other information obtained by you from us. By enrolling in the services, you hereby agree to this limitation of liability and release Katrina Cox Nutrition LLC from any and all claims.

By participating in and/or purchasing the Product, you agree to release, forgive, forever discharge, defend, indemnify, and hold harmless Katrina Cox Nutrition LLC, our subsidiaries, employees, agents, contractors, subcontractors, shareholders, directors, officers, coaches, assignees, licensees, and affiliates from any and all claims, suits, actions, charges, demands, liabilities, damages, judgments, and/or costs, related to, or arising out of, your purchase of or participation in the services and/or your breach of any obligation, warranty, covenant, or representation set forth in these Terms of Use.

By enrolling in the services, you agree to release us from any and all claims, and further agree to at all times defend, indemnify, and hold harmless Katrina Cox Nutrition LLC as stated in this section herein.

  1. NON-DISPARAGEMENT. Client agrees, during and after participation in the Services, that they will refrain from making any remark, comment, message, information, declaration, communication or other statement of any kind, whether verbal, in writing, electronically transferred or otherwise, that might reasonably be construed to be derogatory or critical of, or negative toward, the Company’s programs, business, services, products or reputation.
  2. DISCLAIMER OF WARRANTIES. The information, education, and advice provided to the Client by the Company under this Agreement are provided on an “as-is” basis, without any warranties or representations express, implied or statutory; including, without limitation, warranties of quality, performance, non-infringement, merchantability or fitness for a particular purpose. Nor are there any warranties created by a course of deal, course of performance or trade usage.
  3. OUR REFUND POLICY. Due to the instant access/downloadable nature of the services, refunds will not be issued for the Product once it is purchased. We will do everything within our ability (and within reason) to ensure your satisfaction.   4. LIMITATION OF LIABILITY. By using KATRINA COX NUTRITION, LLC. services and purchasing these Services, Client accepts any and all risks, foreseeable or non-foreseeable, arising from such transaction. Client agrees that we will not be held liable for any damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of the Program. Client agrees that use of this Program is at user’s own risk.


  1. ARBITRATION CLAUSE. If you have any complaint or should any issue arise in the use of the Product, please contact us directly first by emailing the support team at katrina@katrinacoxrd.com.

However, if we are unable to amicably resolve your dispute in that manner, you agree that you and Katrina Cox and Katrina Cox Nutrition LLC shall submit your dispute to binding arbitration with the American Arbitration Association, before an arbitrator that is mutually agreed upon, in accordance with the American Arbitration Association’s (“AAA”) rules.

By agreeing to this term, you hereby agree and understand that you’re waiving your right to a jury trial in court, which would otherwise be available to you if not for this Arbitration Clause. Should any arbitration hearing need to be held, it shall be held within 50 miles of Providence, RI.

If the arbitrator issues an award and a judgment is made, the judgment will be binding and will be entered in court in the State of Rhode Island. The only award that can be issued to you is a refund of any payment made to Katrina Cox Nutrition LLC for the applicable service. You are not permitted to seek additional damages, including consequential or punitive damages.

  1. PAYMENT AND PURCHASE TERMS. When you pay for the services by credit card, you authorize and give permission to Katrina Cox Nutrition LLC to charge your credit or debit card for the amount owed for payment of the Product. When you purchase the Product, your information (i.e. credit card and contact info) may be collected by the third-party merchant Shopify who may have privacy policies or security practices that are different than ours. Katrina Cox and Katrina Cox Nutrition LLC is not responsible for the merchant’s independent policies or practices.
  2. USER CONTRIBUTIONS. Through User participation in the Product, User may post materials, comments, or replies to comments (“User Contributions”) on Product pages and materials. User grants Company a royalty-free, non-exclusive, worldwide license to copy, display, use, broadcast, transmit, and make derivative works of all User Contributions.


  1. SEVERABILITY. The provisions of these Terms of Use shall be deemed severable, and the invalidity or unenforceability of any provision shall not affect the validity and enforceability of any other provision hereof. If any Section, subsection, sentence, or clause of these Terms of Use shall be adjudged illegal, invalid, or unenforceable, such illegality, invalidity, or unenforceability shall have no effect on the Terms of Use as a whole or on any Section, subsection, sentence, or clause hereof not expressly so adjudged.

By purchasing and/or participating in the service, you implicitly signify your agreement to all of the terms in these Terms of Use.
